Being arrested for a DUI can be overwhelming, stressful, and confusing. What you do in the hours and days afterward can have a major impact on your case, your license, and your future. Here’s a simple guide to help you take the right steps and protect yourself.
1. Stay Calm and Don’t Say More Than You Have To
After an arrest, emotions run high. The most important thing is to stay calm and avoid answering questions about drinking or impairment. You have the right to remain silent — use it. Provide basic information only, such as your name and identification.
2. Write Down Everything You Remember
Details fade quickly, and even small things can help your attorney. As soon as possible, write down:
Where you were stopped
What the officer said or did
Whether field sobriety tests were given
Any breath or blood tests performed
Weather or road conditions
Witnesses who were present
These notes may become valuable evidence later.
3. Request a License Hearing (If Applicable)
In many states, you only have a short window — usually only 10 days from the date of your arrest — to request a hearing to challenge your license suspension. Missing this deadline can result in an automatic loss of driving privileges — without an ability to appeal the decision.
4. Avoid Discussing Your Case With Anyone Else
Do not talk about your DUI arrest with friends, family, coworkers, or on social media. Anything you say can be (and usually is used against you. Your attorney should be the only person you discuss your case with.
5. Contact a DUI Attorney Right Away
A DUI charge comes with serious consequences, including:
License suspension
Fines and fees
Mandatory classes
Possible probation or jail time
An experienced DUI attorney can review the evidence, guide you through the process, negotiate on your behalf, and help protect your record and future.
6. Keep Track of Court Dates and Requirements
Missing a deadline or failing to comply with court instructions can seriously harm your case. Stay organized and follow everything that your attorney advises you.
Facing a DUI? You're Not Alone.
A DUI arrest doesn’t define you, and you don’t have to navigate the process by yourself. With the right legal guidance, many people avoid severe penalties and find a clear path forward.
